Terms and Conditions for Mold Testing Services
By purchasing mold testing services from Three Rivers Mold Testing (“Company”), the client (“Client”) agrees to the following terms and conditions:
- Scope of Services:
- The Company will conduct a visual inspection of the specified areas and collect air, swab, and/or tape samples for laboratory analysis.
- The inspection is limited to the condition of the property at the time of the inspection and the areas that are readily accessible.
- The inspection and testing are not exhaustive and do not guarantee the presence or absence of mold or other microbial growth.
- Report:
- The Client will receive a written report of the visual inspection and the laboratory analysis results.
- The report is based on the samples collected and does not cover areas that are inaccessible or not tested.
- The report does not comply with any legal obligations of disclosure and is for the Client’s use only.
- Limitations and Exclusions:
- The Company is not responsible for undetected species of microbial growth or other pathogens.
- Mold can exist in areas not accessible during the inspection, such as behind walls or under carpets.
- Limitation of Liability:
- The Company’s liability is limited to the purchase price of the testing services.
- The Company and its employees are not insurers, and the services provided are not guarantees or warranties of any kind.
- The Client agrees to hold the Company harmless from any liabilities, demands, claims, and expenses related to injuries or property damage arising from the inspection and testing.
- Exclusivity:
- The report is for the sole use of the Client and is not transferable or assignable.
- There are no third-party beneficiaries to this Agreement.
- Limitations Period:
- Any legal action arising from this Agreement must be commenced within one year from the date of the inspection.
- Governing Law and Jurisdiction:
- This Agreement is governed by the laws of the State of Indiana.
- Any litigation arising from this Agreement shall be filed in the court having jurisdiction in the County where the Company has its principal place of business.
- Severability:
- If any provision of this Agreement is declared invalid or unenforceable, the remaining provisions will remain in effect.
- Entire Agreement:
- This Agreement represents the entire understanding between the Parties. No other statements or promises made by the Company or its employees shall be binding unless in writing and signed by both Parties.
